To me it looks like Lovense outted themselves as being negligent and thus is liable for mishandling the whole situation from my view

Against people and media outlets who reported the issue or reported on the issue.
Their handling of the situation is close to as bad as it gets. Starting with taking 14 months(!) to address a wide open security hole.

Guaranteed they didn’t actually fix the problems, just plastered over them. Threatening legal action is to prevent people looking under the hood.
